Our goal is the resolution of the dispute by mediation. Mediation acquires importance where the parties have interest in an ongoing relationship as the legal court process usually ends by breaking up all kinds of relations between the parties and this is not where the parties aim to arrive because of the already exing relationships, partnerships or other.
The Alternative Dispute Resolution is cheaper, quicker, not adversarial, much wider range of outcomes with ADR than with courts, flexibility, longer lasting, leaves control of the outcome with the parties.
ADR may not be effective if one of the parties is unwilling to cooperate or compromise.
Arbitration is best for cases where the parties, especially companies that want another person to decide the outcome of their dispute for them but would like to avoid the formality, time, and expense of a trial. It may also be appropriate for complex matters where the parties want a decision-maker who has training or experience in the subject matter of the dispute.
